A new appeal in Classification for Alfredo Cospito. His lawyer Flavio Rossi Albertini has challenged the appeal ruling by which last July the anarchist was sentenced to 23 years in prison for massacre, redetermining the previous sentence – life – following a ruling by the Constitutional Court.
Lawyer Rossi Albertini talks about «illogical motivation» of the sentence, «contradictory with what was found in order to the gravity of the crime, and wrong in law».
This is why, in quantifying the penalty in the minimum editorial for «the extreme modesty» of the crime as it was carried out – the explosion of two ordinances in front of the carabinieri barracks in Fossano, in June 2006, without causing any deaths or injuries – the Turin Court of Appeal denied any mitigation, «valuing the outstanding criminal capacity revealed by the defendant, for how it detracts also and mainly from the serious crimes subject to the process».
The lawyer of Cospito, also, discovers vices of motivation in the sentence that, even by virtue of what the Consulta said, would violate «the basic principle of proportionality of punishment».
The appeal, drawn ten days ago, arrived at the Court of Appeal in Turin for the next forwarding to Classification.
